Notice was received yesterday that the Federal Energy Regulatory Commission approved the transfer of the license for Kerr Dam to NorthWestern Energy “contingent upon: (1) transfer of title of the properties under license, transfer of all project files including all dam safety related documents, and delivery of all license instruments to NorthWestern Corporation which shall be subject to the terms and conditions of the license as though it were the original licensee; and (2) NorthWestern Corporation acknowledging acceptance of this order and its terms and conditions by signing and returning the attached acceptance sheet. By October 24, 2014, the transferee shall submit certified copies of all instruments of conveyance and the signed acceptance sheet.”

We asked Senator Verdell Jackson about this recent turn of events.  He was not surprised, and had expected it.  Senator Jackson explained that he remains committed to continuing his pursuit of addressing the issues raised in his intervention documents, and will take whatever steps are necessary to ensure that western Montanans interests are protected in the licensing arrangements for the pending transfer of Kerr Dam to the CSKT scheduled for September of 2015.
