To help those of you who are still planning to submit an objection to the Flathead Water Compact Decree, we are pleased to be able to share with you an objection that was submitted to the Montana Water Court yesterday.
It is being shared with the approval of the objectors, who began this process with the need to protect their own valuable water and property rights in the context of the proposed Flathead Water Compact decree, but also with their desire to right a horrible wrong.
By sharing the objection, you will see that it was written not only for the protection of their own interests, but with the hopes that it will be helpful to everyone that will be harmed if the Flathead Compact is finalized by the water court.
It is a testimony to all of the hard work of the people who have worked diligently to put forth significant reasons as to why the Montana Water Court should reject the Flathead Water Compact.
The objectors are happy to share their objection (below) with the hope that it will inspire your own objection to the compact. You are welcome to share and use this document.
Our sincerest thanks to the objectors, and to all who participated in the development of, and submission of the objection:
Notice of Objection and Request for Hearing: Sego/Slack
We also want to take time to thank all of the Water Warriors, you know who you are, who over the years have testified in Helena, contacted legislators, attended meetings, wrote letters, traveled all around the state, and took other actions to bring awareness to this horrible water compact. Without your efforts, the development of this objection may not have been possible.
PLEASE SHARE IT FAR AND WIDE!!!!!
AND DON’T FORGET, OBJECTIONS ARE DUE TO THE WATER COURT NO LATER THAN FEBRUARY 9, 2023. Be sure to follow instructions of the water court including sending copies of your objection to all of the parties as specified by the Water Court.
Water Court Public Notifications Related to Flathead Water Compact
Very well written. Thank you for allowing the rest of affected water users the opportunity to read and use the document. Appears to state what should have been obvious to the framers of the Flathead Water Compact.
Is there an example of a simplified form of objection available for the average domestic user?
The water court has posted three files with the objections that they received prior to the original December 2022 deadline.
You can find links to them here:
We can’t point you directly to a domestic water use objection, but hopefully you can look through these three documents to find an objection that will be helpful to you.
